Paying income tax with the intention of Sadaqah

Question:
Can one pay income tax to SARS with the intention of giving Sadaqah?
Answer:
Sadaqah is something you give voluntarily out of love of Allah and zeal for thawab (Tahtawi Alad Durr Vol. 1 Pg. 432) without anything in return. However if one is obliged to pay tax to the government and makes niyyah for sadaqah it will be correct. (Shaami Vol. 2 Pg. 289). It is advised that a person not make such a niyyah because if sinful activities are funded with that money, a person may be party to assisting in sin. Let it be that you are being forced to give it.
